What is Mediation?
Mediation is facilitated negotiation or conflict resolution that occurs outside of the legal system. It is a process for people involved in disputes to construct their own decisions and regain control over their lives.

What is Divorce Mediation?
It is the informal process of resolving a dispute run by a trained third party. In family law, spouses can choose to mediate all of the financial, visitation and custody issues, which accompany any divorce. Issues that are most often covered in mediation include the following:
- Terms governing child custody
- Terms governing visitation
- Maintenance / unallocated support payments
- Structure of future payments in light of tax considerations
- Educational plans for the children
- Disposition of the marital residence
- Division of marital and non marital property
- Division of marital and non marital debt
What are the Benefits of Divorce Mediation vs. a Traditional Divorce?
- It is generally a less stressful and emotional process
- Generally shorter duration than a traditional divorce
- Less expensive (according to the NY Times it is 40-60% less expensive)
- Better for children
- Does not expose them to the legal system
- More private and confidential
- Uses cooperation and problem solving skills – best attributes of people
- Has a lower rate of re-litigation and compliance
How Does the Process Work?
The couple and the mediator meet in a series of mediation sessions, usually 1 - 2 hours long.
- Initially: The couple and the mediator identify the issues that need to be discussed and the order in which they will be discussed, then decide what information needs to be gathered and shared.
- Further Meetings: Discussions revolve around how to compromise on the various issues in order to meet the needs of both parties. The mediator assists by providing information about the court system and common ways divorce issues are resolved
- The Agreement: When an agreement has been reached on all issues, the mediator drafts the agreement for review by each of the parties and their attorneys, if any. It is common to have an attorney look over the final agreement.
